India has officially implemented a new labour law from November 21, bringing major reforms that directly affect how employees’ gratuity will now be calculated.
One of the biggest shifts is that fixed-term and contract employees will now be eligible for gratuity after completing just one year of service.For permanent employees, the rules remain unchanged, meaning gratuity will still be granted only after completing five years of continuous service.Another major update is that gratuity will no longer be calculated only on the basic salary, but will now include 50% of all allowances such as DA and other components.This means that as your basic salary adjusts under the new structure, your PF and gratuity contributions will also increase.To understand the difference, imagine an employee earning Rs 70,000 a month, with Rs 30,000 as basic pay and Rs 40,000 as allowances.Under the old rule, gratuity after ten years would be calculated only on the ₹30,000 basic salary, resulting in a total of Rs 1,73,076.Under the new rule, since the allowances exceed the basic by Rs 10,000, half of the excess—Rs5,000—gets added to the calculation, making the effective basic Rs 35,000 and increasing gratuity to Rs 2,01,923, which is Rs 29,000 more.For someone with a Rs 6 lakh annual CTC, gratuity under the old rule would be calculated only on the Rs 3 lakh basic, whereas the new rule adds eligible allowances, raising the calculation base and increasing the final payout.At a Rs 12 lakh CTC, the old rule uses the Rs 6 lakh basic as the gratuity base, but the new law pushes this amount up to Rs 7.9 lakh after adding allowances, resulting in a substantially higher gratuity.For employees earning Rs 24 lakh annually, the old rule calculates gratuity on the Rs 12 lakh basic, while the new law raises the calculation base to Rs 15.8 lakh, significantly boosting the amount you receive.Disclaimer: These figures are meant to offer general clarity, and it’s important to consult your HR or a financial expert before making any decisions based on the new gratuity rules.
