Lodha Vs Lodha: In a rare instance of a family feud spilling into the courtroom, two prominent names from the Indian real estate sector — Abhishek Lodha and his younger brother Abhinandan Lodha — have finally reached an amicable settlement over the usage of the ‘Lodha’ brand. The dispute, which had sparked a legal tussle between Macrotech Developers and the House of Abhinandan Lodha (HoABL), has now been resolved under the guidance of their parents and with the help of senior retired judges.
“In a significant development, the Lodha brothers — elder brother, Abhishek Lodha and younger brother, Abhinandan Lodha — and the companies led by them, have amicably resolved all outstanding disputes under the guidance of their parents,” according to a statement.
What Was the Dispute?
The conflict arose when Macrotech Developers, led by Abhishek Lodha, filed a suit in January in the Bombay High Court against HoABL. The listed company alleged trademark infringement, claiming that the use of the ‘Lodha’ brand by Abhinandan’s firm could cause confusion in the market and dilute the brand equity it had built over the years.
Macrotech Developers, formerly known as Lodha Developers, is one of India’s largest real estate firms with luxury and premium residential projects under the ‘Lodha’ brand. HoABL, launched by Abhinandan Lodha, focuses on selling land and residential plots across major Indian cities. The clash centered around the legacy family name, and both parties claimed a right to its commercial usage.
How Was It Resolved?
Under the guidance of their parents, and with the intervention of retired Justice R V Raveendran and encouragement from Justice Arif Doctor, the two brothers agreed to settle the matter outside the court. Both companies issued similar statements announcing that they had amicably resolved all outstanding disputes.
The long-running trademark dispute between real estate heirs Abhishek Lodha and Abhinandan Lodha took a new turn with their mother, Manju Lodha, stepping in to urge reconciliation. In a letter addressed to her sons in February, she had called for an immediate end to their legal battle and reminded them of the 2017 Amended Family Agreement, which she emphasised should be the guiding document for resolving the matter. Her intervention came as the Bombay High Court has appointed a mediator to help broker a settlement.
Who Gets What?
Abhishek Lodha & Macrotech Developers:
– Will exclusively continue using the brand names ‘Lodha’ and ‘Lodha Group’.
– Macrotech remains the sole owner of these trademarks.
– Abhinandan Lodha and his firm have no claim over Macrotech Developers or any business run by Abhishek.
Abhinandan Lodha & HoABL:
– Will operate exclusively under the brand name ‘House of Abhinandan Lodha’.
– Has no rights to the ‘Lodha’ or ‘Lodha Group’ trademarks.
– Abhishek Lodha will not have any claim over HoABL or any business run by his younger brother.
What’s Next?
Both parties have clarified that ‘Lodha Group’ and ‘House of Abhinandan Lodha’ are entirely separate and unrelated entities, and they plan to communicate this widely to avoid any consumer confusion. This marks a crucial step in de-escalating tensions and maintaining individual brand identities while preserving family dignity.
“Lodha Group’ and ‘House of Abhinandan Lodha’ have no connection with each other. Both entities will communicate this widely,” as per the statement.
“Both Abhishek and Abhinandan express their heartfelt gratitude to Justice R V Raveendran (Retd.), whose guidance in the mediation process was invaluable. The family is grateful to the Justice Arif Doctor for encouraging them to follow the process of mediation,” the statement said.
